文化權已逐漸成為近代學術界一個新的重要議題。而聯合國《經濟、社會暨文化權利國際公約》(International Covenant on Economic, Social and Cultural Rights)的實施除了強調資源的公平分配,更提出了過去較少提及的少數族群權益之平衡,尤其在當今強調多樣性的大環境下,如何確保少數族群的文化權利以豐富文化的多樣性,更是值得深究。本文將從人權觀念的演進談起,提出對文化權定位與實踐的相關見解,並回顧孫中山思想中與文化權相關的部份。接著淺析中國對西藏政策是否兼顧圖博(Tibet)民族的文化權,以及臺灣對少數族群文化權的保障等方向來作為比較觀察,最後提出結論與期許。
The "culture rights" has become a new important issue in recent years. The International Covenant on Economic, Social and Cultural Rights emphasized not only the fair distribution of resources, but also the equation of minorities' rights. Making sure of minorities that have culture rights to enrich the diversity of culture deserves our research, especially now environment which respects the multiplicity. This paper starts with the evolution of human rights. In the next place we bring the position and practicing ways of culture rights and review the relevance in the thought of Sun Yat Sen. Finally we analyze and compare China's Tibet policy (see if being considerate of Tibet's culture rights) with Taiwan's culture policy (protection of minorities' culture rights), in order to make the expectation.
