Abstract

  人名入憲涉及到一些憲法議題,即憲法的基本性與至高性,是指導還是被指導?是規範還是被規範?它擺放的位置與內容又涉及到有無法律效力問題,涉及到有無侵犯平等、自由的疑義。或者說,涉及主流觀點對憲法性質、憲法價值、憲法功能的定義,此皆值得研究。本文僅就兩岸和其他四國憲法為本,比較研究人名入憲現象、原因、效力及趨勢,並加以評述。

Abstract

  Personal name in a constitution involves a number of constitutional issues, such as: Is the constitution still fundamental and supreme? Is it the guide or be guided? Does it normalize or be normalized? Mentioning a personal name in a constitution also involves the following questions: Does it have the legal effect? And, does it harm the rights of equality and freedom? In other words, the issues in question worthwhile studying, is related to the mainstream view of the definition of the constitution, its values, and functions. This article compares the constitutions across the Taiwan Strait and four other countries’ constitutions, commenting on the issues of the phenomenon, the reason, the effectiveness, and the trend of putting personal names in the constitution.
