中華民國是五權制度,與西方三權制度不同。監察權是五權制度中一個獨特的設計,雖然可監督五院,但主要仍是監督行政部門,所以,檢視行政與監察的互動關係,對瞭解監察權具有特別意義。
監察權運用下列權限來監督行政權:彈劾權、糾舉權、糾正權、審計權、調閱權、調查權、巡察權、陽光法案執行權。但執行這些權限時也受到一些限制:例如,約詢官員時,有時遭到拒絕出席,法律並未規定如何懲罰。彈劾官員後,需送到司法院公懲會審議,有時彈劾案件遭到擱置或退回,引起兩院爭議。至於調閱文件時,有時行政部門隱藏甚或銷毀文件,使監察院在調查時缺乏足夠證據成案。至於糾正案,行政部門有時敷衍了事,使糾正案功能不彰。

Unlike the Western three-power system, the ROC’s government system is the five-power system. Among the five branches of government, Control Yuan is a unique design whose main function is to supervise the government and officials to see if they violate the law or have dereliction of duty. Though the Control Yuan oversees all the government bodies, its supervision lies primarily on the Executive Yuan.
The Control Yuan utilizes the following powers to supervise the Executive Yuan: impeachment power, censure power, correction power, audit power, power to access to documents and files, power to investigate, power to inspect, power to implement the Sunshine Act. However, there are some limitations for Control Yuan to exercise these powers. For instance, when being investigated, some officials decline to be questioned. No legal punishment can be inflicted on them. As for the impeachment power, Control Yuan, like the prosecutors, can only impeach officials but has to wait for the final decision of the Commission on the Disciplinary Sanctions of Functionaries, which often time has different views with the Control Yuan or postpones the cases until the final ruling of court is given. In regard to reviewing documents and official files, sometimes government agencies decline to provide or conceal the files, which lead to the lack of adequate evidence for the control yuan members to establish a case. As for the correction power, there are too many corrected cases against the executive branch, which may cause the heavy workloads of the agencies and sometimes the careless reply of the agencies.
Reforms are needed. Control Yuan members should avoid: 1. frequently asking government ministers to be questioned. 2. providing too many administrative guidance. 3. interfering in the executive decision-making process. 4. the abuse of control power. Only by doing so, can the control power contribute to the good governance of the ROC government.
