  各國政府試圖透過達成「公私協力」的目標,將傳統上屬於公部門的服務,透過外包及競標方式,轉由公司或非營利組織提供;此公私協力的論述有兩個出發點︰一方面希望有效率地減少政府支出,二方面更能建構公私協力的良機。然而,本文認為︰政府若要繼續擁抱外包等市場方式,透過議價的方式委託公共服務,那就須從理論和經驗研究上找出克服問題的方法,政務官、行政官僚以及公共行政的研究者亦都必須了解公部門在應用招標措施的正確知識以避免錯誤的認知。
  本文先從中山先生對「萬能政府」的期許出發,檢視其對資本的主張—「發達國家資本」、「節制私人資本」和「利用外國資本」;其次,以公共選擇理論的觀點,分析公部門招標制度導致招標者(公部門)及議價者(私部門)的特殊策略性行為,並論證公私「協力」的理念似乎過於一廂情願,若未能克服制度缺陷,或可能反成為「公私挾利」;也因此,議價中所產生的負面效果,更待學界進行後續研究。

  In many countries, the government tries very hard to maintain good partnerships between the public and the private by outsourcing services, which was traditionally provided by the public sections, to companies or NPOs, or they can bid for them. By maintaining good partnerships between the public and the private, not only can reduce government expenditure efficiently, but also create good chances for them to cooperate with each other. However, this article suggests that if the government insists on outsourcing or bidding as ways to provide public services, it must come up with solutions, which is based on theories and experimental researches, to problems. Political appointees, bureaucrats, and researchers of public administration all need to have a real and correct understanding to tender.
  This shows that the ided of "the multi-purpose government" which Dr. Sun Yat-sen had in mind was that of an ideal standard which nation or country should try to reach. The paper simply affirms the capital disposition of Dr. Sun Yat-sen's proposition - "the developed country capital", "controls the private capital" and "uses the foreign capital".
  This article uses Public Choice Theory to analyze the tendering system in public sector will cause the tenderer (the public) and bidder(the private) comes up with strategic actions, and demonstrates that the maintaining of the partnerships between the public and the private is way too wishful. If we can not overcome these system defects, it could turn into the situation that the private and the public cheating on each other. As a consequence, the negative effects resulting from bidding needs further research.
